Prohibited Activities

DMCA Notice and Takedown Policy

Kinder Adventure complies with the Digital Millennium Copyright Act (DMCA) and will respond promptly to notices of alleged copyright infringement. If you believe that your copyrighted work has been uploaded to Kinder Adventure without authorization, please send a DMCA takedown notice to our designated Copyright Agent.

Filing a DMCA Takedown Notice

Your notice must include the following information as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or authorized representative
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the infringing material and information reasonably sufficient to permit us to locate it

Counter-Notification

If you believe that your content was removed in error or that you have the right to use the material, you may file a counter-notification. Your counter-notification must include:

  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
  4. Your name, address, telephone number, and email address
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Kinder Adventure may be found
  6. A statement that you will accept service of process from the complainant

Repeat Infringer Policy

Kinder Adventure has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. Kinder Adventure may also, at its sole discretion, limit access to the service and/or terminate the accounts of any users who infringe upon any intellectual property rights of others.

Content Removal

We reserve the right to remove any content that:

  • Is subject to a valid DMCA takedown notice
  • We reasonably believe infringes on third-party copyrights
  • Violates our Terms of Service
  • Is reported by users as potentially infringing

Content will typically be removed within 24-48 hours of receiving a valid takedown notice.

Educational Fair Use

While Kinder Adventure is an educational platform, we encourage users to understand that "fair use" is a complex legal doctrine with specific limitations. Simply labeling content as "for education" does not automatically make it fair use. If you're unsure whether your use qualifies as fair use, we recommend:

AI-Generated Content

Study materials generated by our AI from your uploaded documents are derivatives of your uploaded content. You retain all rights to:

  • Your original uploaded documents
  • The AI-generated study materials derived from your uploads

However, if your original upload contained copyrighted material you didn't have rights to use, the AI-generated derivatives may still constitute copyright infringement.

Governing Law

This Copyright Policy is governed by the copyright laws of the United States, including the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and applicable international copyright treaties.
